General Terms and Conditions of Pension Peißen Owner S. Röpke

§ 1 SCOPE OF APPLICATION

1.1. These terms and conditions apply to contracts for the rental of guesthouse rooms for accommodation, as well as all other guesthouse services provided to the customer.

1.2. The subletting or re-letting of the rooms provided and their use for purposes other than accommodation require the prior consent of the guesthouse in text form, whereby § 540 paragraph 1 sentence 2 BGB is waived insofar as the customer is an entrepreneur within the meaning of § 14 BGB.

§ 2 Conclusion of the contract

2.1. The accommodation contract is deemed to have been concluded when the guest has reserved a room by telephone, in writing or by e-mail on the Internet and this has been confirmed by us.

The confirmation by the Pension “Peißen” can also be made by telephone, email or, if desired, by letter.

An accommodation contract is also concluded through conclusive behavior, in particular if a room has been reserved and made available and an explicit commitment is not possible for reasons of time.

2.2. The contractual partners are the “Peißen” guesthouse, represented by Katleen Böttcher, and the guest. If a customer acts on behalf of or for guests registered by him, he is responsible for the liabilities and all obligations arising from the accommodation contract

§ 3 Prices, Payment

3.1. The entire invoice amount is to be paid in cash on the day of arrival.

3.2. The guesthouse is entitled to demand a reasonable advance payment or security deposit upon conclusion of the contract or thereafter. The amount of the advance payment and the payment dates are agreed upon conclusion of the contract.

3.3. If the guest is in arrears with his payment, the guesthouse can terminate the accommodation contract with immediate effect. The guesthouse reserves the right to assert further damages, in particular the failure of other rentals.

3.4. In the event of payment arrears, the pension makes use of its landlord’s lien and can temporarily prevent the removal of items and luggage by self-help until clarification has been achieved.

3.5. The agreed prices include the respective statutory VAT. This is currently 7% for accommodation costs and 19% for breakfast price.

§ 4 cancellation and withdrawal conditions

4.1. A cancellation must always be made in writing (by e-mail, letter). The cancellation fees are staggered as follows:

Cancellations between

14th and 8th days before the day of arrival: 20%,

7th and 3rd days before arrival: 50%,

within 48 hours before reserved booking 100%

the entire invoice amount (without breakfast).

The cancellation conditions are reduced by the amounts that are achieved by re-letting the reserved rooms on the part of the guesthouse. The customer is free to prove that no damage has occurred or that the damage incurred by the pension is lower than the flat rate required.

4.2. If an appointment to withdraw from the contract has been agreed in writing between the guesthouse and the guest, the guest can withdraw from the contract up to that point without triggering any payment or damage claims on the part of the guesthouse. The customer’s right of withdrawal expires if he does not exercise his right of withdrawal in writing (by email, letter) to the guesthouse by the agreed date.

4.3. Furthermore, the pension is entitled to extraordinarily withdraw from the contract for a materially justified reason, for example if force majeure or other circumstances for which the pension is not responsible make it impossible to fulfill the contract,

The guesthouse must inform the guest of the exercise of the right of withdrawal immediately via the communication channel practiced with the customer.

§ 5 Provision, handover and return of rooms

5.1. Unless otherwise agreed upon conclusion of the contract, the guest has no right to be provided with specific rooms.

5.2. Check in: the rooms can be occupied from 1 p.m. If you arrive earlier, your luggage can usually be stored. If the room is already ready for occupancy, it can be occupied earlier.

5.3. If no information is given to the guesthouse about an arrival after 6:00 p.m., the guesthouse is entitled to release the room from 6:00 p.m. and in the following days for further reservations (number of overnight stays) in order to minimize damage.

5.4. Check out: On the agreed departure day, the rooms must be vacated by 11:00 a.m. at the latest. Luggage may be stored free of charge. If the handover takes place after 2 p.m. for reasons for which the guesthouse is not responsible, 100% of the room price without breakfast will be charged.

§ 6 liability of the pension

6.1. The Pension “Peißen” is not liable to the guest or the contractual partner if the provision of services becomes impossible as a result of force majeure. In these cases, the pension endeavors to obtain equivalent services from other sources.

6.2. It is the guest’s responsibility to insure items brought against theft, damage or destruction. The pension is not liable for loss, theft, damage or destruction.

6.3. Wake-up orders, messages, mail and goods shipments for guests are not part of the pension’s range of services. If these services are taken over by agreement in exceptional cases, they must be carried out with the greatest care. Claims for damages, except due to gross negligence or intent, are excluded.

6.4. If the customer makes use of the parking facility on the property at Am Zentrum 15, 06188 Landsberg OT Peißen, for a fee or free of charge, this does not result in a custody agreement. The guesthouse is not liable for loss or damage to motor vehicles parked or maneuvered on the property and their contents.

§ 7 Final Provisions

7.1. Place of performance and payment is the seat of the pension: Landsberg OT Peißen.

7.2. The exclusive place of jurisdiction for all disputes arising from or in connection with the accommodation contract is Landsberg if the guest is a merchant or has no general place of jurisdiction in Germany.

7.3. Should individual provisions of these General Terms and Conditions for the accommodation contract and accommodation in

of the pension be or become invalid or void, this shall not affect the effectiveness of the remaining provisions.

7.4. In addition, the statutory provisions apply.
